SAMFORD, J.

Defendant was convicted of an assault and battery, and appeals. The Attorney General confesses error, and the judgment is reversed and the cause remanded, on authority of Taylor v. State, 17 Ala. App. 508, 85 So. 877. Reversed and remanded.
