Opinion of the Court

BRADLEY, Judge.

Upon remand to this court by the Supreme Court of Alabama it is considered that the decision of the Circuit Court of Montgomery County should be affirmed in accordance with the opinion rendered by the Supreme Court on October 15, 1982, 423 So.2d 850.

AFFIRMED ON REMAND.
