WRIGHT, Presiding Judge.

This case, upon its facts, falls squarely within the law as declared by the Supreme Court in the case of Ward v. Saben Appliance Co., 391 So.2d 1030 (Ala. 1980). Upon that authority the judgment of the trial court must be and hereby is affirmed.

AFFIRMED.
