TYSON, Judge.

This cause is reversed and remanded to the Circuit Court of Mobile County with instructions to grant Butts’ petition for writ of habeas corpus on authority of Butts v. State, 471 So.2d 400 (Ala. 1985).

REVERSED AND REMANDED WITH DIRECTIONS.

All the Judges concur.
