ON REMAND FROM THE ALABAMA SUPREME COURT

PATTERSON, Judge.

Pursuant to the authority of Ex parte Buckner, 549 So.2d 451 (Ala. 1989), the judgment is reversed and the case is remanded.

REVERSED AND REMANDED.
