Opinion of the Court

ON REMAND FROM THE SUPREME COURT OP ALABAMA

ROBERTSON, Judge.

The prior judgment of this court has been reversed and the cause remanded by the Supreme Court of Alabama. On remand and in compliance with the Supreme Court’s opinion in Ex parte Head, 572 So.2d 1276 (Ala. 1990), the judgment is now reversed and the cause is remanded to the trial court for proceedings consistent with the Supreme Court's opinion.

REVERSED AND REMANDED.
