McMILLAN, Judge.

Pursuant to the opinion of the Supreme Court of Alabama in Ex parte Harris, 639 So.2d 949 (Ala. 1993), the judgment of the circuit court is hereby reversed and the cause remanded to the Circuit Court of St. Clair County for proceedings consistent with that opinion.

REVERSED AND REMANDED.
