On Remand from the Supreme Court
The prior judgment of this court has been reversed by the Supreme Court of Alabama and the case remanded. See Ex parte Jenkins, 723 So.2d 649 (Ala. 1998). In compliance with the Supreme Court’s opinion, the judgment of the trial court is reversed and the case is remanded for further proceedings.
REVERSED AND REMANDED FOR FURTHER PROCEEDINGS.
