LONG, Presiding Judge.

On the authority of Ex parte Sparks, 730 So.2d 113 (Ala. 1998), the judgment of the circuit court is reversed and this cause is remanded to the Circuit Court for Calhoun *118County for proceedings consistent with the Supreme Court’s opinion.

REVERSED AND REMANDED.
