McMILLAN, Presiding Judge.

Based on the Alabama Supreme Court’s decision in Ex parte Keeton, 797 So.2d 421 *422(Ala. 2000), the trial court’s judgment is to be reversed and the cause remanded to the trial court.

REVERSED AND REMANDED.
