Concurring Opinion

SHAW, Judge,

concurring in the result.

I cannot agree with the Court’s conclusion in its unpublished memorandum that the appellant failed to preserve the issue whether there was probable cause to believe that he had committed the charged offense. I do, however, agree with the Court’s statement that there was sufficient evidence to support the trial court’s finding of probable cause; therefore, I concur in the result only.
