SHAW, Judge.

On the authority of Ex parte Appleton, 828 So.2d 894 (Ala. 2001), the judgment of the trial court is reversed and this cause is remanded for proceedings consistent with the Supreme Court’s opinion.

REVERSED AND REMANDED.
