McMILLAN, Presiding Judge.

Pursuant to the Alabama Supreme Court’s decision in Ex parte Baker, 906 So.2d 277 (Ala. 2004), this case is remanded to the Houston Circuit Court for a new trial.

REVERSED AND REMANDED.
