Smith v. State

Opinion of the Court

WELCH, Judge.

AFFIRMED BY UNPUBLISHED MEMORANDUM.

McMILLAN and WISE, JJ., concur. BASCHAB, P.J., concurs in the result.

SHAW, J., concurs in the result, with opinion.

Concurring Opinion

SHAW, Judge,

concurring in the result.

I express no opinion as to whether Milas Jason Smith properly preserved for appellate review the trial court’s ruling on his motion to suppress. However, because it is apparent to me that the motion to suppress was properly denied, I concur to affirm the judgment of the trial court.
