Affirmed on the authority of Ellison v. Abbott et al.,1 Ala., 337 So.2d 756 (1976).

AFFIRMED.

TORBERT, C. J., and BLOODWORTH, ALMON, SHORES, EMBRY and BEATTY, JJ., concur. JONES, J., dissents. MADDOX and FAULKNER, JJ., recuse themselves.

. The appeal in this case affirmed the granting of summary judgment filed by only one of the named defendants, Jacksonville State University.
