Roberts v. Roberts

Opinion of the Court

BLOODWORTH, Justice.

WRIT QUASHED AS IMPROVIDENTLY GRANTED.

MADDOX, FAULKNER, JONES, SHORES, EMBRY and BEATTY, JJ., concur. TORBERT, C. J., and ALMON, J., dissent.

Dissenting Opinion

ALMON, Justice

(dissenting).

I most respectfully dissent from quashing the writ. I think the Court should address the issue of whether the Court of Civil Appeals has misapplied the long standing ore tenus rule.

TORBERT, C. J., concurs.
