Affirmed on the authority of Hubbard Brothers Construction Company, Inc. v. C. F. Halstead Contractor, Inc., 294 Ala. 688, 321 So.2d 169 (1975), and Cobb v. Malone, 92 Ala. 630, 9 So. 738 (1891).
