BEATTY, Justice.

Having considered the record and briefs, the Court is of the opinion that the judgment appealed from must be affirmed on the authority of Code of 1975, § 6-5-235, and Dicie v. Morris, 285 Ala. 650, 235 So.2d 796 (1970). It is so ordered.
