I concur in the denial of the writ, but I believe all the claims are subject to the provisions of the Federal Arbitration Act, 9 U.S.C. § 1 et seq. See my dissenting opinion in Old Republic Ins. Co. v. Lanier, 644 So.2d 1258 (Ala. 1994).
