HOUSTON, Justice

(concurring specially).

Nothing before this Court shows that the attorney for Lewis Trucking, Inc., contributed to the creation of the common fund. The trial court found that he did not. By voting to deny the petition for the writ of certiorari, I do not mean to suggest that the result would be the same if the attorney for the employer had contributed to the creation of the common fund.
