R.K.D. v. State

Supreme Court of Alabama
R.K.D. v. State, 712 So. 2d 761 (Ala. 1998)
1998 Ala. LEXIS 87; 1998 WL 110624
Almon, Shores, Houston, Kennedy, Cook, See, Hooper, Maddox, Butts

R.K.D. v. State

Dissenting Opinion

MADDOX, Justice

(dissenting).

This case involves the interpretation of § 13A-12-192(b), Ala. Code 1975, and related sections that make the possession of child pornography a felony. The petition for the writ of certiorari presents an important issue of first impression in this court, and because this Court is the final interpreter of the laws of Alabama, I would grant the petition for certiorari review; therefore, I respectfully dissent.

HOOPER, C.J., and BUTTS, J., concur.

Opinion of the Court

PER CURIAM.

WRIT DENIED. NO OPINION.

ALMON, SHORES, HOUSTON, KENNEDY, COOK, and SEE, JJ., concur. HOOPER, C.J., and MADDOX and BUTTS, JJ., dissent.
