Opinion of the Court

COOK, Justice.

The contractual arrangement in this case and the contract documents out of which this case arises are substantively identical to the ones involved in Beaver Construction Co. v. Lakehouse, L.L.C., 742 So.2d 159 (Ala. 1999). This case is, therefore, controlled by, and the judgment in it is reversed on the authority of, that case.

REVERSED AND REMANDED.
