MADDOX, Justice.

The legal issue presented in this case is the same as that presented in Sheridan v. Board of Water & Sewer Comm’rs of the City of Prichard, 764 So.2d 526 (Ala. 1999). The judgment is affirmed.

AFFIRMED.
