COOK, Justice.

The petition for the writ of mandamus is denied on the authority of Ex parte Empire Fire & Marine Ins. Co., 720 So.2d 893 (Ala. 1998), and Fulmer v. Clark Equipment Co., 654 So.2d 45 (Ala. 1995).
