(dissenting).

I respectfully dissent from the denial of the petition for a writ of certiorari. I agree with Judge Murdock’s dissent from the decision of the Court of Civil Appeals in this same matter, A.L. v. Tuscaloosa County Dep’t of Human Resources, 823 So.2d 686, 692-94 (Ala.Civ.App. 2001).
