The opinion delivered in the case of the County of Washita vs. Simon T. Sanders et al., at the present term, applies equally to this. The judgment of the Washita Circuit Court must, therefore, be reversed, and the cause remanded lor further proceedings therein according to law and not inconsistent with this opinion.
