17 Petitioner filed a motion for an extension of time to file a petition for writ of certiorari.
18 ECF No. 1. On August 31, 2020, the undersigned granted petitioner thirty days to file a petition for writ of habeas corpus and an application to proceed in forma pauperis in order to properly commence this action. ECF No. 3. Petitioner was further warned that failure to comply with the order would result in a recommendation that this matter be dismissed. Id. To date, petitioner has not responded to the court’s order, nor taken any action to prosecute this case.
23 Accordingly, IT IS HEREBY ORDERED that the Clerk of the Court randomly assign a District Judge to this action; and 25 IT IS HEREBY RECOMMENDED that this action be dismissed, without prejudice, for lack of prosecution and for failure to comply with the court’s order. See Fed. R. Civ. P. 41(b); Local Rule 110.
28 These findings and recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within fourteen days after being served with these findings and recommendations, any party may file written objections with the court. The document should be captioned “Objections to Magistrate Judge’s Findings and Recommendations.” Any response to the objections shall be filed and served within fourteen days after service of the objections. The parties are advised that failure to file objections within the specified time may waive the right to appeal the District Court’s order. Martinez v. Ylst, 951 F.2d 1153 (9th Cir. 1991).
