Hartigan v. Charter Communications, Inc.
Trial Court Opinion
1 2 3 4 5 6 7 8 9 UNITED STATES DISTRICT COURT 10 SOUTHERN DISTRICT OF CALIFORNIA 11 12 RAEANON HARTIGAN, individually Case No.: 3:19-cv-01962-H-MDD and on behalf of others, 13 ORDER DENYING JOINT MOTION Plaintiff, 14 TO STAY PROCEEDINGS v. 15 CHARTER COMMUNICATIONS, INC. [Doc. No. 14.] 16 dba SPECTRUM, 17 Defendant. 18
19 On February 28, 2020, the parties filed a joint motion asking the Court to: 20 (i) stay this case for approximately three months – until June 26, 2020 – pending a decision 21 in Barr v. American Association of Political Consultants, Inc., No. 19-631 (U.S. Jan. 10, 22 2020) and (ii) vacate the date set for the early neutral evaluation conference. (Doc. No. 14.) 23 The power to stay a case is “incidental to the power inherent in every court to control 24 the disposition of the causes on its docket with economy of time and effort for itself, for 25 counsel, and for litigants.” Landis v. North American Co.,
299 U.S. 248, 254(1936). The 26 Court has reviewed the parties’ papers and, exercising its discretion, determines that the 27 circumstances of this case do not warrant a stay. An early neutral evaluation conference is 28 an opportunity for the parties to discuss the merits of their positions at an early stage and 1 potentially settle the dispute without further costly litigation. The impact of the Supreme 2 Court’s decision in Barr v. American Association of Political Consultants, Inc. is, at this 3 point, purely speculative. Accordingly, the Court DENIES the joint motion and declines 4 the request to convert the early neutral evaluation conference into an attorneys only 5 telephonic hearing. 6 IT IS SO ORDERED. 7 DATED: March 5, 2020
