ALLISON, CDCR Secretary, 15 Respondent. 16 17 18 In 2004, Petitioner was convicted of numerous counts of rape, residential 19 burglary, forcible oral copulation, assault with the intent to commit a sex offense, 20 forcible sexual penetration by a foreign object, and forcible sodomy. As a result of a 21 prior “strike” conviction, Petitioner was sentenced to 1040 years to life in prison. 22 (ECF 1; see also People v. Rathbun,

, at *1 (Aug. 23, 2007). 23 Petitioner appealed to the California Court of Appeal, which affirmed the judgment, 24 but remanded the case for re-sentencing. Rathbun,

, at *1. On 25 October 31, 2007, the California Supreme Court denied review. (ECF 1 at 6; see 26 https://appellatecases.courtinfo.ca.gov.) 27 On May 20, 2008, Petitioner filed a petition for a writ of habeas corpus in the 28 Central District of California challenging his 2004 conviction. Rathbun v. Scribner, 1 | Case No. CV 08-3339-AG (PJW). On March 30, 2010, judgment was entered 2 || denying the petition on the merits and dismissing the action with prejudice. 3 || Petitioner’s request for a certificate of appealability was also denied. 4 The current petition for a writ of habeas corpus, filed on April 12, 2021, again 5 | challenges Petitioner’s 2004 conviction and sentence. “Before a second or 6 || successive application permitted by this section is filed in the district court, the 7 || applicant shall move in the appropriate court of appeals for an order authorizing the 8 || district court to consider the application.”

(b)(3)(A). Absent 9 || authorization from the Court of Appeals, this Court lacks jurisdiction over a 10 |) successive petition. See Magwood v. Patterson,

(9th Cir. 2001). 12 Because Petitioner has not obtained authorization from the Ninth Circuit to file 13 || this second or successive petition, this Court is without jurisdiction to entertain it.! 14 || See Burton v. Stewart,

Pursuant to Ninth Circuit Rule No. 22-3(a), when a request for authorization to file a successive 26 || petition is “mistakenly submitted” to a district court, it must be referred to the Ninth Circuit. Rule 22-3(a) also provides that a district court may refer such a petition to the Ninth Circuit when to so 27 || would serve the interests of justice. Neither circumstance is present in this case. Nevertheless, the Clerk is directed to mail petitioner a copy of Ninth Circuit Form 12 so that petitioner may file an 28 application for leave to file a second or successive petition in the Court of Appeals.
