(“Super Micro”) and Defendant PCPC Direct, Ltd. 23 (hereinafter “Defendant”) hereby stipulate, agree and respectfully request that the Court issue an 24 order dismissing this action and retaining jurisdiction over the parties’ settlement agreement. The 25 parties submit the following facts in support of this request: 26 1. The parties have reached a settlement in this action. 27 2. The terms of the settlement involve performance over time. 28 1 3. The settlement includes a stipulation for entry of judgment that permits Super 2 Micro to seek entry of a stipulated judgment if there is a default of certain terms under the 3 settlement agreement. 4 4. The parties have agreed to jointly request that the Court dismiss the case pursuant 5 to Federal Rule of Civil Procedure 41(a) and retain jurisdiction over the terms of the settlement 6 agreement and enforcement of the stipulation for entry of judgment until all conditions of the 7 settlement agreement have been performed. 8 IT IS SO STIPULATED.
