12 13 This matter comes before the Court upon consideration of Plaintiff’s ex parte application 14 to serve a subpoena in advance of the initial case management conference. Having considered the 15 Complaint, the application, and the declarations submitted in support of the application, the Court 16 concludes that Plaintiff has established that “good cause” exists for it to serve a third party 17 subpoena on Comcast Cable (hereinafter the “ISP”). See No. 08-cv-1093-SBA, UMG Recording, 18 Inc. v. Doe,

, *4 (N.D. Cal. Sept. 3, 2008); Arista Records LLC v. Does 1-19, 19

(D.D.C. 2008). 20 Accordingly, it is HEREBY ORDERED: 21 1. Plaintiff may serve the ISP with a Rule 45 subpoena commanding the ISP to 22 provide Plaintiff with the true name and address of the Defendant to whom the ISP assigned an IP 23 address as set forth on Exhibit A to the Complaint. Plaintiff shall attach to any such subpoena a 24 copy of this Order. 25 2. Plaintiff may also serve a Rule 45 subpoena in the same manner as above on any 26 service provider that is identified in response to a subpoena as a provider of Internet services to 27 one of the Defendants. 1 states: 2 the term “cable operator” means any person or group of persons 3 (A) who provides cable service over a cable system and directly or through one or more affiliates owns a significant interest in such 4 cable system, or 5 (B) who otherwise controls or is responsible for, through any arrangement, the management and operation of such a cable system. 6 7 it shall comply with

(c)(2)(B), which states: 8 A cable operator may disclose such [personal identifying] information if the disclosure is . . . made pursuant to a court order 9 authorizing such disclosure, if the subscriber is notified of such order by the person to whom the order is directed. 10 11 4. Accordingly, the ISP shall serve a copy of the subpoena and a copy of this Order on 12 the subscriber within 30 days of the date of service on the ISP. The ISP may serve the subscribers 13 using any reasonable means, including written notice sent to the subscriber’s last known address, 14 transmitted either by first-class mail or via overnight service. 15 5. Each subscriber and the ISP shall have 30 days from the date of service upon him, 16 her, or it to file any motions in this Court contesting the subpoena (including a motion to quash or 17 modify the subpoena). If the 30-day period lapses without the subscriber contesting the subpoena, 18 the ISP shall have 10 days to produce to Plaintiff the information responsive to the subpoena with 19 respect to that subscriber. 20 6. The ISP shall preserve all subpoenaed information pending the ISP’s delivering 21 such information to Plaintiff or the final resolution of a timely filed motion to quash the subpoena 22 with respect to such information. 23 7. Plaintiff may only use the information disclosed in response to a Rule 45 subpoena 24 served on the ISP for the purpose of protecting and enforcing Plaintiff’s rights as set forth in its 25 Complaint. 26 8. Any name or other personal identifying information of any current or proposed 27 defendant shall be filed provisionally under seal. In so doing, Plaintiff is instructed to follow the ] redacted version of all documents in the public record should redact only Defendant’s name and 2 || any other personal identifying information. Plaintiff shall continue to use the current caption of 3 || the case, including the assigned IP address.
