28 U.S.C. § 636, the Court has reviewed the Petition, the 20 records on file, and the Report and Recommendation of United States 21 Magistrate Judge (“Report”). No Objections to the Report have been filed. 22 The Court accepts the Report and adopts it as its own findings and 23 conclusions. Accordingly, the Petition is denied with prejudice. 24 Further, the Court finds that Petitioner has not made a substantial 25 showing of the denial of a constitutional right or that the court erred in its 26 procedural ruling and, therefore, a certificate of appealability will not issue in 27 this action. See
