No objections to the Report and Recommendation have 23 been filed within the time allowed. Having completed its review, the Court accepts 24 the findings and recommendations set forth in the Report and Recommendation. 25 Defendant’s Motion for Summary Judgment is granted on the basis that 26 Plaintiff’s claims are barred under Heck v. Humphrey,

(1994). Thus, 27 Plaintiff may refile his claims if he is successful in invalidating his conviction 28 through appropriate means.
