28 U.S.C. § 636, the Court has reviewed the Petition, the 21 records on file, and the Report and Recommendation of United States 22 Magistrate Judge (“Report”). Because the time for objections has passed with 23 none filed, the Court need not review de novo the findings and conclusions in 24 the Report. See Thomas v. Arn,
474 U.S. 140, 154(1985); United States v. 25 Reyna-Tapia,

| Further, for the reasons stated in the Report, the Court finds that 2 || Petitioner has not made a substantial showing of the denial of a constitutional 3 || right and, therefore, a certificate of appealability is denied.
