17 Petitioner is a state prisoner without counsel seeking a writ of habeas corpus pursuant to 28 U.S.C. § 2254. On January 6, 2023, the court dismissed the petition with leave to amend pursuant to Rule 4 of the Rules Governing Section 2254 cases. ECF No. 8. The court granted petitioner 30 days to file an amended petition. Id. The court also warned petitioner that failure to comply could result in a recommendation that this action be dismissed. Id. The time for acting has passed and petitioner has not filed an amended petition or otherwise responded to the court’s order. Thus, it appears that petitioner is unable or unwilling to cure the defects in the petition.
24 Accordingly, it is ORDERED that the Clerk of the Court randomly assign a United States District Judge to this action.
26 Further, it is RECOMMENDED that this action be DISMISSED for the reasons stated in the January 6, 2023 order.

In his objections petitioner may address whether a certificate of appealability should issue || in the event he files an appeal of the judgment in this case. See Rule 11, Rules Governing Section || 2254 Cases (the district court must issue or deny a certificate of appealability when it enters a | final order adverse to the applicant).
