18 Petitioner, a state prisoner proceeding pro se, brings this petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. Pending before the Court is Petitioner’s petition for a writ of habeas corpus, ECF No. 1.

21 The Court has examined Petitioner’s petition as required by Rule 4 of the Federal Rules Governing Section 2254 Cases. It does not plainly appear from the petition and any attached exhibits that Petitioner is entitled to relief. See id. Specifically, Petitioner’s claim is largely indecipherable and, to the extent coherent, does not appear to relate to the fact or duration of Petitioner’s present confinement. See Preiser v. Rodriguez, 411 U.S. 475, 500 (1973); see also Neal v. Shimoda, 131 F.3d 818, 824 (9th Cir. 1997); Trimble v. City of Santa Rosa, 49 27 F.3d 583, 586 (9th Cir. 1995) (per curiam). Petitioner will be provided leave to amend.

28 / / / ] Moreover, Petitioner has not named the proper respondent. “A petitioner for || habeas corpus relief must name the state officer having custody of him or her as the respondent to | the petition.” Stanley v. California Supreme Court, 21 F.3d 359, 360 (9th Cir. 1994); see also | Rule 2(a), Federal Rules Governing Section 2254 Cases. Petitioner will be provided leave to || amend.

6 Accordingly, IT IS HEREBY ORDERED that: 7 1. Petitioner’s petition for writ of habeas corpus, ECF No. 1, is dismissed || with leave to amend; 9 2. Petitioner shall file an amended petition on the form employed by this || court, and which names the proper respondent and states all claims and requests for relief, within | 30 days of the date of this order; and 12 3. The Clerk of the Court is directed to send Petitioner the Court’s form || habeas corpus application.
