1] L □□ □ 3 Now before the Court is the motion to dismiss pursuant to Federal Rules of Civil || Procedure 12(b)(6) filed by Defendant Arizona Beverages USA, LLC. In response to the motion 15 || to dismiss, Plaintiff has filed an amended complaint. The amended complaint supersedes the A 16 || original complaint, and the original complaint no longer performs any function. See Ramirez v. || Cty. of San Bernardino, 806 F.3d 1002, 1008 (9th Cir. 2015); see also Fed. R. Civ. P. 15(a)(1)(B).

Z 18 || Accordingly, Defendant’s motion to dismiss and the motions to seal are DENIED AS MOOT.

19 || The Court VACATES the hearing date of March 31, 2023.
