United States District Court for the Northern District of California

SpecOil LLC v. Remet Alcohols, Inc.

Trial Court Opinion

1 UNITED STATES DISTRICT COURT 2 NORTHERN DISTRICT OF CALIFORNIA 3 4 5 SPECOIL LLC, Case No. 23-cv-05754-NC Plaintitt, ORDER TO SHOW CAUSE WHY 6 CASE SHOULD NOT BE Vv. DISMISSED FOR LACK OF 7 SUBJECT MATTER REMET ALCOHOLS, INC., et al., JURISDICTION 9 Defendants. Re: ECF 1

10 This Court orders SpecOil LLC (“SpecOul”’) to show cause why this case should not 11 || be dismissed for lack of subject matter jurisdiction. Federal courts are courts of limited 3 12 || jurisdiction. Kokkonen v. Guardian Life Ins. Co. of Am.,

511 U.S. 375, 377

(1994). g 13 || District courts have subject matter jurisdiction through federal question or diversity 14 || jurisdiction.

28 U.S.C. §§ 1331

, 1332. Diversity jurisdiction requires complete diversity 15 || of citizenship and an amount in controversy greater than $75,000.

28 U.S.C. § 1332

(a). Z 16 || SpecOil claims this Court has diversity jurisdiction, but does not provide sufficient 5 17 || information to establish diversity of citizenship. See ECF 1 (“Compl.”) 95. 5 18 SpecOil states it “is an Indiana limited liability company, with its principal place of 19 || business in Texas.” Compl. 41. But “for the purposes of diversity ... an LLC is a citizen 20 || of every state of which its owners/members are citizens.” Johnson v. Columbia Properties 21 || Anchorage, LP,

437 F.3d 894, 899

(9th Cir. 2006). Without information on the citizenship 22 || of SpecOil’s owners/members, this Court cannot assess whether complete diversity exits. 23 Accordingly, SpecOil must show cause in writing by November 22, 2023, why this 24 || case should not be dismissed for lack of subject matter jurisdiction. 25 IT IS SO ORDERED. 26 27 || Dated: November 8, 2023 Rh — 28 United States Magistrate Judge
