The 22 Commissioner’s final decision shall be reversed and remanded for further administrative 23 proceedings before an Administrative Law Judge (ALJ). Upon remand, the Appeals Council 24 will vacate the prior ALJ decision and instruct an ALJ to offer Plaintiff the opportunity for a 25 hearing, further develop the record, and issue a new decision. 26 Remand shall be made under sentence four of

42 U.S.C. § 405

(g). See Melkonyan v. 27 Sullivan,

501 U.S. 89

(1991). Plaintiff shall be entitled to reasonable attorney fees and expenses 28 pursuant to

28 U.S.C. § 2412
