17 A suggestion of death upon the record pertaining to the death of plaintiff was filed on May 28, 2024. Pursuant to Federal Rule of Civil Procedure 25(a), the court ordered that a motion for substitution be filed no later than August 26, 2024. No motion has been filed. Accordingly, IT IS HEREBY RECOMMENDED that this action be dismissed.
