The time granted for 19 that purpose has expired, and plaintiff has not filed an amended complaint, or otherwise 20 responded to the court’s order. 21 In accordance with the above, IT IS HEREBY ORDERED that the Clerk of the Court is 22 directed to assign a district judge to this case; and 23 IT IS RECOMMENDED that this action be dismissed without prejudice for failure to 24 state a claim, for reasons described in the order filed November 1; for failure to prosecute; and for 25 failure to follow a court order.
