ECF No. 8. Plaintiff has not filed an opposition to this motion.

24 Accordingly, it is hereby ORDERED that the Clerk of Court randomly assign a district judge to this matter.

26 Further, it is hereby RECOMMENDED that: 27 1. The Commissioner’s motion to remand, ECF No. 8, be granted.

1 2. The Clerk of Court be directed to enter a final judgment in favor of plaintiff and 2 against defendant, reversing the final decision of the Commissioner.

3 3. The Clerk of Court be directed to close this matter.
