17 18 Plaintiff proceeds pro se in this action attempting to state a claim for an alleged civil rights 19 violation under

. (ECF No. 1.) This matter was referred to the undersigned by 20 Local Rule 302(c)(3) pursuant to

(b). 21 On September 30, 2024, the court issued an order and findings and recommendations 22 screening the complaint pursuant to

(e) and dismissing the complaint with leave 23 to amend. (ECF No. 4.) Plaintiff was granted thirty days to file an amended complaint or to file a 24 notice of voluntary dismissal of the action. Plaintiff was warned that failure to respond would 25 result in a recommendation that this action be dismissed. The time granted for plaintiff to respond 26 has expired and plaintiff has neither filed an amended complaint nor filed a motion for voluntary 27 dismissal. 28 Based on the foregoing, IT IS RECOMMENDED: ] 1. This action be dismissed for failure to state a claim and failure to prosecute. See Fed. 2 R. Civ. P. 41(b); and 3 2.
