No. 10) Plaintiff, 19 v. 20 THE COUNTY OF SACRAMENTO, 21 Defendant. 22 23 Before the court is the parties’ joint stipulation requesting that the court consolidate two 24 cases currently pending before the undersigned: (i) Everest National Insurance Company v. 25 County of Sacramento, 2:25-cv-00399-DC-AC (“Everest”) (Doc. No. 12); and (ii) Allied World 26 National Assurance Co. v. The County of Sacramento, 2:25-cv-00400-DC-AC (“Allied”) (Doc. 27 No. 10). The court related and reassigned these cases on March 19, 2025. (Everest, Doc. No. 14; 28 Allied, Doc. No. 12.) 1 Pursuant to Rule 42(a) of the Federal Rules of Civil Procedure, “[i]f actions before the 2 | court involve a common question of law or fact, the court may: (1) join for hearing or trial any or 3 | all matters at issue in the actions; (2) consolidate the actions; or (3) issue any other orders to 4 | avoid unnecessary cost or delay.” In exercising its discretion, the court “weighs the saving of time 5 | and effort consolidation would produce against any inconvenience, delay, or expense that it 6 | would cause.” Huene v. United States,
743 F.2d 703, 704(9th Cir. 1984). 7 Here, the court finds that the above-captioned actions involve the same or similar parties, 8 | claims, and questions of fact or law, and that consolidation will avoid unnecessary costs and 9 | duplication of proceedings. Thus, good cause exists to consolidate these cases. 10 Accordingly, 11 1. The parties’ joint stipulation requesting that the court consolidate cases 2:25-cv- 12 00399-DC-AC (Doc. No. 12) and 2:25-cv-00400-DC-AC (Doc. No. 10) is 13 GRANTED; 14 2. The above-referenced cases are hereby consolidated for all purposes, including 15 trial, pursuant to Federal Rule of Civil Procedure 42(a); 16 3. The Clerk of the Court is directed to file this order in each of the above-referenced 17 cases; and 18 4. Going forward, the parties and the Clerk of the Court are directed to file 19 documents under only the lead case number. The Clerk of the Court is directed to 20 administratively close the member case.
