Plaintiff was given thirty days to file an amended complaint and 19 cautioned that failure to do so would result in a recommendation that this action be dismissed. Id. 20 at 5. After plaintiff failed to file an amended complaint, he was given an additional twenty-one 21 days to amend the complaint and warned that failure to do so would result in a recommendation 22 that this action be dismissed without further warning. ECF No. 11. Twenty-one days have now 23 passed, and plaintiff has not filed an amended complaint or otherwise responded to the court’s 24 order. 25 Accordingly, IT IS RECOMMENDED that the complaint be dismissed for failure to state 26 a claim for the reasons set forth in the December 30, 2024, Screening Order (ECF No. 8). See 27 L.R. 110; Fed. R. Civ.
