25 1 Frank Bisignano, the new Commissioner of Social Security, should be substituted as the defendant in this suit per F.R.C.P. Rule 25(d). No further action 26 1 Riberal (“Riberal”) be awarded attorney fees and expenses in the amount of five 2 thousand one hundred dollars ($5,100.00) under the Equal Access to Justice Act 3 (EAJA),
28 U.S.C. § 2412(d), and costs in the amount of zero dollars ($0.00) under 4
28 U.S.C. § 1920. This amount represents compensation for all legal services 5 rendered on behalf of Plaintiff by counsel in connection with this civil action, in 6 accordance with
28 U.S.C. §§ 1920; 2412(d). 7 After the Court issues an order for EAJA fees to Riberal, the government 8 will consider the matter of Riberal's assignment of EAJA fees to Young Cho. The 9 retainer agreement containing the assignment is attached as exhibit 1. Pursuant to 10 Astrue v. Ratliff,
130 S.Ct. 2521, 2529(2010), the ability to honor the assignment 11 will depend on whether the fees are subject to any offset allowed under the United 12 States Department of the Treasury's Offset Program. After the order for EAJA fees 13 is entered, the government will determine whether they are subject to any offset. 14 Fees shall be made payable to Riberal, but if the Department of the Treasury 15 determines that Riberal does not owe a federal debt, then the government shall 16 cause the payment of fees, expenses and costs to be made directly to Law Offices 17 of Lawrence D. Rohlfing, Inc., CPC, pursuant to the assignment executed by 18 Riberal.2 Any payments may be made by check or electronic fund transfer (EFT)
19 and shall be delivered to the Law offices of Lawrence D. Rohlfing, Inc. 20 This stipulation constitutes a compromise settlement of Riberal's request for 21 EAJA attorney fees, and does not constitute an admission of liability on the part of 22 Defendant under the EAJA or otherwise. Payment of the agreed amount shall 23 constitute a complete release from, and bar to, any and all claims that Riberal 24
