ORDER AND FINDINGS AND RECOMMENDATIONS 14 SAN JOAQUIN COUNTY JAIL, 15 Respondent. 16 17 Petitioner, a state prisoner, filed a petition for writ of habeas corpus challenging jail 18 discipline. (ECF No. 1.) A filing fee of $5.00 is required to commence a habeas corpus action in 19 federal district court.

(a). The court may authorize the commencement of an 20 action “without prepayment of fees and costs or security therefor, by a person who makes 21 affidavit that he is unable to pay such costs or give security therefor.”

(a). 22 By order filed on July 21, 2025, petitioner was ordered to submit an affidavit in support of 23 his request to proceed in forma pauperis or the appropriate filing fee. Petitioner was cautioned 24 that failure to do so would result in a recommendation that this action be dismissed. The time 25 granted has expired and petitioner has not paid the fee, filed the required documents, or otherwise 26 responded to the court’s order. 27 For the reasons set forth above, IT IS ORDERED that the Clerk of the Court is directed to 28 assign a district judge to this case; and ] IT IS RECOMMENDED this action be dismissed without prejudice. 2 These findings and recommendations are submitted to the United States District Judge 3 || assigned to the case, pursuant to the provisions of
