16 17 18 On October 2, 2025, Plaintiff filed a notice stating, “[u]nder Federal Rules of Civil 19 Procedure 41(A), this action is dismissed without prejudice by the Plaintiff in its entirety.” (ECF 20 No. 10, p. 1). The Court notes that no Defendant has yet served either an answer or motion for 21 summary judgment. 22 Accordingly, in light of the voluntary dismissal, this action has been terminated, Fed. R. 23 Civ. P. 41(a)(1)(A)(i), and has been dismissed without prejudice. See Wilson v. City of San Jose, 24
