15 16 Petitioner is a state prisoner proceeding pro se with a petition for writ of habeas corpus 17 pursuant to

. 18 On August 29, 2025, the Court denied Respondent’s motion to dismiss and allowed 19 Petitioner to proceed with the procedure set forth in Kelly v. Small,

(9th Cir. 20 2002). (ECF No. 20.) On September 24, 2025, Petitioner filed a first amended petition (“FAP”) 21 containing only exhausted claims. (ECF No. 21.) 22 On September 25, 2025, the Court stayed the instant proceedings pending exhaustion of 23 state remedies and ordered Petitioner to file a status report within thirty days and every ninety 24 days thereafter. (ECF No. 22.) The Court also ordered that within thirty days following the final 25 order of the state courts, Petitioner must file an amended petition including all exhausted claims. 26 (Id.) 27 On December 4, 2025, Petitioner lodged an amended petition asserting four claims for relief, including the previously unexhausted Ground Four. (b)(1). A petitioner can 3 | satisfy the exhaustion requirement by providing the highest state court—in this case, the 4 | California Supreme Court—with a full and fair opportunity to consider each claim before 5 | presenting it to the federal court. O’Sullivan v. Boerckel,

(1999); Duncan v. 6 | Henry,

(1995); Picard v. Connor,

(1971). 7 Upon review of California’s Appellate Courts Case Information website, it appears that 8 | Petitioner has not filed a state habeas petition with the California Supreme Court.' Thus, 9 | Petitioner must inform the Court whether Ground Four has been presented to the California 10 | Supreme Court,’ and if possible, provide this Court with a copy of: (1) the petition filed in the 11 | California Supreme Court that includes Ground Four and a file stamp showing that the petition 12 | was indeed filed in the California Supreme Court; and (2) the California Supreme Court’s order 13 | regarding said petition. 14 Accordingly, IT IS HEREBY ORDERED that within THIRTY (30) days of the date of 15 | service of this order, Petitioner SHALL file either: (a) a copy of her petition filed in the 16 | California Supreme Court that includes Ground Four and the California Supreme Court’s order 17 | regarding said petition; or (b) a status report regarding whether she has presented Ground Four to 18 | the California Supreme Court. 19 IT IS SO ORDERED.
