PER CURIAM.

This case turns upon the question whether or not a certain deed was intended to be a mortgage. The court below found that it was not a mortgage. The ingenious argument of counsel for the appellant has cast some doubt-upon the correctness of this conclusion. Nevertheless, upon the evidence in the record, we do not feel warranted to declare that the court below erred in its decision. The judgment and order denying a new trial are affirmed.
